2 – Acceptance of the general conditions

 

Any booking on this website entails a complete and unreserved agreement on the General Conditions of Sale, and no booking can be made without an agreement on these General Conditions of Sale. The customer declares to have a perfect knowledge of the General Conditions of Sale.

 

3 – PURPOSE

This website allows to book accommodation and related services in hotels operated under the Birgit brand.When booking, the Customer acknowledges:a description of the accommodation offered and any additional services (payed or included in the price of accommodation),The price of the servicePayment terms (payment schedule and accepted means of payment)These general conditions of saleThe customer therefore declares to have a perfect knowledge of the service he reserves and to be solely responsible for the choice of service he has reserved.These General Terms and Conditions of Sale apply to all reservations concluded by the websites and concluded directly in establishments under the Birgit brand in France.

 

4 – BOOKING

For any booking of less than 8 rooms, the booking is confirmed once payment (deposit or full) for the service has been made by the customer and accepted by SNC Vauban’s Payment Partner.For group bookings (more than 8 rooms), and barring exceptions which may be stipulated by any written means (for example following an agreement with a travel agent) the booking is confirmed when the Customer makes payment by bank transfer or bank card for a first deposit.The customer agrees to provide, at the time of booking, all the information necessary for his identification and the choice of his stay, and certifies their authenticity.Once the booking has been made, a confirmation is sent to the email address provided by the Customer.A booking is nominative. It cannot be assigned or transferred to another person.Completion of the booking will constitute proof of a contractual relationship between the Customer and SNC Vauban.

 

5 – CANCELLATIONS

Flexible bookings cancellable until 3 p.m. on the day of arrival,

Non-cancellable / Non-refundable bookings are neither modifiable nor cancellable nor refundable after reservation.

For reservations of more than 8 rooms:

Total cancellation: accommodation, restaurant, rented spaces

This agreement between the hotel and your company can only be terminated in writing.

Partial cancellation: accommodation, restaurant, rented spaces

The reduction in the number of participants is considered as a partial cancellation of the reservation giving rise to the application of the cancellation conditions above for any cancellation exceeding the terms below:

From D-90 to D-61 before the Group’s arrival date: the Hotel invoices 50% of the total amount including tax of the canceled services (minus the deposit previously paid).

From D-60 to D-31 before the date of arrival of the Group: the Hotel invoices 75% of the total amount including tax of the canceled services (minus the deposit previously paid).

Less than 30 days before the date of arrival of the group: the Hotel invoices 100% of the total amount including tax of the canceled services (minus the deposit previously paid).

6 – CONDITIONS OF THE STAY AT THE HOTEL
The interruption of a stay at the request of the customer will not entitle you to any refund, even partial.The accommodation reserved by the customer will be available no later than 4 p.m. on the day of his arrival, unless he has reserved the possibility of an early check in. The customer must leave his room no later than 12:00 the morning following the last night reserved, unless he has reserved a late check out. In this specific case, the booking confirmation email will specify the departure time. In case of late check-out, the hotel may consider this as an extension of stay and reserves the right to charge an additional night.

 

Pendant son séjour, le Client devra se conformer au Règlement Intérieur de l’hôtel. Celui-ci précise les règles de vie au sein de l’établissement, dans les chambres et dans les espaces partagés. Il précise notamment les dispositions suivantes :

During his stay, the Customer must comply with the Internal Rules of the hotel. This specifies the rules of life within the establishment, in the rooms and in the shared spaces. It specifies in particular the following rules:– It is forbidden to consume alcohol outside the bar / restaurant– It is forbidden to smoke (including an electronic cigarette) outside the spaces specifically designated for this purpose.– It is forbidden to invite in a room a person who is not accommodated at the same time in the establishment.In the event of non-compliance with these rules of procedure, the management of the establishment may terminate the client’s stay, without the latter being able to claim any compensation or a partial refund for the remainder of his stay. .In addition, SNC Vauban reserves the right to register the Customer on a list of customers prohibited from staying in establishments of the Grape Hospitality group.In this case, the Customer will be refused access to any establishment of the Grape Hospitality group, for an indefinite period, which the Customer expressly accepts.

 

7 – RESPONSABILITY OF GRAPHE HOSPITALITY

Photographs and descriptions of the establishment presented on the websites of the Grape Hospitality group may not exactly represent the service provided by the establishment, which the customer expressly acknowledges.

Grape Hospitality cannot be held responsible for the bad progress of the reservation or stay due to a case of force majeure, the default of a third party, or the unavailability of the website.

Any complaint related to a reservation or stay problem must be made to the establishment directly, at its postal address, within 30 days of the date of arrival of the reservation.

Grape Hospitality is not directly the operator of the establishment.

 

8 – EVOLUTION OF THE PRICE OF THE STAY
The prices indicated at the time of booking are subject to change at the time of the stay, in the following cases:– Change in the price of the tourist tax, included in the reservation price– Change in the rate of Value Added Tax, the reservation prices being expressed All Taxes Included– Any exchange costs related to a transaction carried out in foreign currencies at the request of the customer, the prices of the reservation being always expressed in euros. 9 – FULL PAYMENT OF THE STAY AT THE TIME OF BOOKINGIf the customer has chosen a rate including full payment of the stay at the time of booking, this payment is made by credit card, via the platform of the Payment Partner of SNC Vauban, Adyen or Stripe. The credit card will be debited within 24 hours of booking.Upon arrival at the establishment, the customer may be asked to present an identity document to verify that he is actually the holder of the Bank Card used at the time of the reservation.An invoice may be requested at the end of the stay at the reception of the establishment.

10 – PAYMENT OF THE STAY UPON ARRIVAL IN THE ESTABLISHMENT

If the customer has chosen a rate including payment for the stay upon arrival at the establishment, they will be asked when booking to guarantee their reservation by providing their bank card details. He/seh must then present him/herself, at the beginning of his stay, with the same bank card, and the establishment may ask him to present an identity card to verify that he is indeed the legitimate holder of the Bank Card.

11 – SECURITY OF PAYMENTS – PAYMENT PARTNER – CONSERVATION OF CONTRACTUAL DOCUMENTSSNC Vauban entrusted Adyen with the security of its online payments by credit card. The validity of the Bank Card is checked by Adyen. A refusal of the Bank Card, for any reason whatsoever (blocked card, stolen card, payment limit reached) will result in the cancellation of the reservation request, which will therefore not be confirmed.The contractual documents (invoice, reservation email, credit card transaction receipt) will be kept for a period of 10 years in electronic format.

 

12 – RELOCATIONIf it is impossible to offer the Customer the service he has reserved, the establishment may offer him accommodation of equivalent or higher quality within the same establishment or in a neighboring establishment. Any additional costs will be borne by the establishment. The Customer will have the possibility of refusing this dislodging, and will be able to ask for the refund of his reservation without being able to claim any indemnity or compensation. The establishment reserves the right to make a commercial gesture. 13 – RESPECT FOR PRIVACY AND PERSONAL DATAFor the purposes of proper performance of the Service, SNC Vauban is required to collect personal data, including the Client’s IP address. This data is intended for SNC Vauban or hotels operated by Grape Hospitality.At the time of online booking, the customer’s Bank Card data will be transmitted to SNC Vauban’s Payment Partner, Adyen. The Customer expressly consents to the transfer of this data. Adyen has the best data security certifications.

In accordance with the General Data Protection Regulations (GDPR), the Customer has the right to access and rectify his personal data.

For this, the Customer is requested to contact the reception of the establishment concerned or to communicate his request to the email address: dpo@grape-hospitality.com.

 

14 – COMMERCIAL SOLICITATIONSThe Customer agrees, when booking online, to receive a booking confirmation email. The Client also agrees to receive an e-mail from SNC Vauban a few days before his arrival at the establishment. Finally, the customer agrees to receive an email from SNC Vauban a few days after leaving the establishment. These e-mails are intended to prepare the Customer’s stay and to collect their satisfaction comments.They may also contain commercial offers.

In addition, by having booked a stay in the establishment, via the Grape Hospitality sites as by any other means, the Customer agrees to receive a regular Newsletter from Grape Hospitality. He may unsubscribe via a link at the bottom of the newsletter.

Les données du Client ne seront pas communiquées à d’autres entreprises.

15 – FORCE MAJEURE

In the event of Force Majeure, as recognized by the case law of the French courts, neither the customer, nor SNC Vauban, nor the reserved establishment can be held responsible for the non-performance of the reserved service.

 

16 – DISPUTES AND APPLICABLE LAW

In the event of a problem or dissatisfaction with the service he has reserved, the Customer may, within 30 days of his stay, contact the management of the establishment reserved.

These General Terms and Conditions of Sale and the Reservation are subject to French law and any dispute arising from their validity, interpretation or execution will fall within the jurisdiction of the Tribunal de Grande Instance de Paris.

 

17 – FINAL PROVISIONS
These General Conditions of Sale are written in French. If a translation is made in a foreign language, it will only have indicative value and only the French version will prevail.In the event of an update to these General Terms and Conditions of Sale, the new version will automatically apply to any reservation made after this update.These General Conditions of Sale, the Pricing Conditions applicable to the service requested, and the booking confirmation constitute the entirety of the obligations of the Parties. In case of contradiction between these documents, the provisions of the booking confirmation take precedence over those of these general conditions of sale.If one or more of the provisions hereof prove to be invalid or void, the other provisions hereof shall nevertheless remain valid.
